It's not the cable provider that requires encrypted channels. It's the channel provier themselves that set that requirement most of the time. The fear is that the full digital copyrighted material would be available in the open. That would allow anyone to "tap" into the cable plant and record the media. Since this is the channel providers cash cow if you would, they want to make sure everything possible is done to prevent that. Set top boxes as a hole will never go away as encryption will always be needed. This is nothing more than an OCAP compliant set top box that connects USB to the computer, maintaing it's copy right so that you cannot record saved media on another medium.

I really don't think its ATI's preference to not sell directly to users. The requirements the cable industry is keeping place it probably the deciding factor. They've created a cash cow, eliminated vcr's and can't stand cablecards. The FCC fell down by allowing putting the burden on consumers to decrypt the incoming signal. The cable provider should be responsible for providing an unencrypted signal into the house. Eliminating the need for the set-top box.
